  • Terms and Conditions

The following conditions govern the course of the “Runes of Magic 10th Anniversary Contest” (“contest”) as organised by Gameforge 4D GmbH, Albert-Nestler-Strasse 8, 76131 Karlsruhe, Germany (“Gameforge”).

    1. Eligibility, Participants and Participation

    (1) Participation in the contest is free. All users of full age – including members of the voluntary support team (teamlers) – who comply with the requirements of the Standard Terms and Conditions of Use, and who have a personal, active account (“account”) for runesofmagic.gameforge.com are eligible to enter.

    (2) A “participant” is any person entitled to participate as per (1) who participates as described in (3) between 18th March 2019 and 7th April 2019, 11:59 PM CET (“participation period”).

    (3) The subject of the contest is the independent creation of three screenshots which each depict a character belonging to the account in a special gaming moment for the participant (“screenshots”). Each screenshot should have a comment of up to 50 words in English explaining why the moment is special (“comments”) and together with the screenshots they should be submitted in accordance with the following requirements (together the “entry”):

    a) The entry must be free of any other rights of third parties.

    b) The screenshots must be submitted in .JPG, .BMP, .PNG, .GIF or .TIFF format with a maximum file size of 5 MB; the comments should be submitted in .TXT, .DOC, .DOCX or .PDF format. The total size of the entry must not exceed 20 MB.

    c) Neither the user interface nor any personal data (e.g. character names or chat messages) should be visible on the screenshots. Editing the screenshots is permitted for this purpose.

    d) The entry must be sent to 10_anniversary@runesofmagic.com from the email address associated with the account with the subject line “RoM 10th Anniversary”.

Further, the email should also detail the game server associated with the account, and the name of the character portrayed. It should also state how the participant wishes to be identified as the copyright holder as the creator of the comments as part of the presentation, should they win. If the participant does not provide any indication of preference, they provide their general agreement that the provision of the character name and server being played on is sufficient as identification. Should the participant prefer to eschew any form of identification, they may indicate as such in their entry.

    (4) Each participant is permitted only one entry. Entries submitted outside of the participation period as well as multiple entries, including entries linked to different accounts, will not be considered.

    2. Winners and Prizes

    (1) Gameforge will select 7 entries from all valid entries. The “winners” are those participants who created these selected entries.

    (2) Gameforge will announce the winners by 19th April 2019 on the internet sites (including the Runes of Magic Steam page) and social networks maintained by Gameforge (together the “Gameforge sites”) using the respective game servers and the form of identification chosen as per 1(3)(d), and inform them of their win via an email sent to the email address used for the entry (“notification”).

    (3) The winners will receive prizes as part of the contest announcement. The prizes will be dispatched by a delivery service provider (“service provider”) commissioned by Gameforge from 26th April 2019 and requires a valid postal address (“address”). Gameforge will ask the winners in the notification to provide their address in reply by 17th May 2019, 11:59 PM CET at the latest (“response”). The winners can also indicate their preferred T-shirt size (M or L). Where possible, Gameforge will take this preference into consideration, however there is no entitlement to a specific T-shirt size. Responses that Gameforge receives late or does not receive at all will lead to loss of entitlement to the respective prize.

    (4) The prizes are deemed to have been awarded to the winners by Gameforge with the handover of the prizes to the service provider. If a prize cannot be delivered as the result of an erroneous address supplied by the winner, this will be at the expense of the affected winner.

    (5) Finally, in recognition of the winners’ efforts, Gameforge will present the entries on the Gameforge sites, providing the form of identification as per 1(3)(d) (“presentation”).

    (6) A cash payment and/or payment of the prize in physical goods as well as an exchange and/or transfer of the prizes to third parties are all excluded.

    3. Rights of Use and Indemnity

    (1) For the purpose of participation in the contest, Gameforge grants the participant the free-of-charge, non-exclusive right to use the required elements of the online game Runes of Magic to the necessary extent.

    (2) For the purposes of the presentation, the participant grants Gameforge the free-of-charge, non-exclusive right to use the respective comments without limitation of time and place. This includes the rights of exploitation and reproduction, as well as the right to make the comments publicly available and grant usage rights to third parties, in so far as this is necessary within the context of the presentation.

    (3) By submitting their entry, the participant provides assurance that they produced the screenshots and comments themselves, guarantees that these do not infringe on the rights of third parties and indemnifies Gameforge against all claims from third parties based on the infringement of third party rights in connection with the entries.

    4. Data Privacy

    (1) Gameforge will collect the personal data provided by the participants (including user data for the account, i.e. the associated character name, email address, the address and T-shirt size as provided by winners, and the form of identification chosen per 1(3)(d)) in accordance with data protection requirements and process this exclusively for the purposes of running the contest. This includes checking eligibility for participation and adherence to the participation requirements, as well as, where applicable, the delivery of the prizes and provision of the address to the server provider, the notification and the announcement of the winners on the Gameforge sites using the identification chosen as per 1(3)(d).

    (2) The personal data collected will initially be stored for the duration of the contest and then subsequently deleted. This excludes the identification chosen according to 1(3)(d) publicized on the Gameforge sites as part of the presentation, which is stored permanently for reasons of transparency. To the extent that legal retention requirements stipulate longer-term storage, the affected data will be deleted at the latest following the expiry of such obligations.

    (3) Further information on the handling of personal data by Gameforge can be found within the Privacy Policy (see in particular point 3.9 for the holding of contests and the significant legal bases for the associated processing of this as well as point 6 on the rights of the affected person).

    5. Disclaimer

Gameforge, its bodies, employees, and subcontractors are liable exclusively for wilful intent and gross negligence, regardless of legal basis, and in cases of ordinary negligence, only for the violation of essential contractual obligations and limited to foreseeable damages, as far as not precluded by other compulsory statutory provisions. These limitations do not apply for the loss of life, personal injury or damage to health.

    6. Final Provisions

    (1) The participant agrees to these Terms and Conditions with their entry.

    (2) In addition to these Terms and Conditions, the Standard Terms and Conditions of Use and the game rules also apply (together the “rules”).

    (3) Should a participant infringe upon the rules during the implementation and execution of the contest, or such an infringement be proven thereafter, their eligibility may be revoked.

    (4) Gameforge reserves the right to end the contest before the end of the participation period, if for technical or legal reasons its proper execution cannot be guaranteed.

    (5) In the event that any individual provisions of these Terms and Conditions become ineffective, the remaining provisions shall remain effective and binding. Statutory rules shall take the place of the ineffective provision.
